hi! this is d.j. banovitz,colorado personal injury and accident trial lawyer practicingin denver, colorado. what often happens when folks watch tv orwhen they're in trial, people make objections. you may haveseen that on tv where somebody says "objection!" and thecourt says "sustained!" or "objection!" and the court says"overruled!" why is the lawyer making an objection and whatdoes it mean to have that objection either sustained oroverruled. if the lawyer is making an objection it's becausethere's a question that's been
asked that is an improperquestion. it's either looking to get testimony or elicit -bring out - evidence that is irrelevant, immaterial, or isunfair to the other party. so by making that objection we'reasking the court to keep that evidence from coming in. andwhen the court says "sustained!" then the person who is beingasked that question doesn't need to give an answer to thatparticular question and the bad information - the irrelevantinformation, the unfair information - doesn't come in.likewise, when a lawyer makes an
objection hoping to keep thatinformation out and the judge says the "objection isoverruled", the person who's been asked that question isallowed to answer and whatever information comes out as aresult of that question, it's there for the jury to be heardand for them to consider in deliberations. now, why am itelling you this? because you've seen it on tv and at some pointif you've been in an auto accident, you may end upin trial yourself. so it's important to know what happensduring a case. now, if you have
