it's a long, hard fought trial. the defenseattorney is an excellent lawyer. now, you're on trial for two weeks. now, as you get closerto verdict, as you get closer to the end of the trial, the defense makes a significantsettlement offer. you agree to the settlement offer. do you ever see a trial attorney whonow accepts the settlement offer do the touchdown dance? and say yes! goal! we won! do you eversee anybody who does that? do you want to know why that's not going to happen? comejoin me for a moment as i share with you some terrific information.hi. i'm gerry oginski. i'm a new york medical malpractice and personal injury attorney practicinglaw here in the state of new york. you're never going to see a trial attorney at theend of a case when he finally settles a case

after a hard fought, long battle turn aroundin the middle of the courtroom and start doing the touchdown dance. or yell goal! or i scored!you're never ever going to see that. want to know why not? it's because most of thesegreat trial attorneys are extremely professional. they will accept it in stride. they'll behappy and joyous inside, they'll be jumping for joy inside that they just achieved a greatresult for their client and now maybe outside they'll celebrate with their client, but,in the courtroom, you're never, ever going to see that. why?what happens during the course of a settlement is that it's really a business decision. thedefense recognizes that there is significant exposure if they allow a jury to go aheadand create a verdict and put a value on this

particular case so the defense is taking awayall the risk. now, they're opting to pay a certain amount of money to compensate theinjured victim. the injured victim is also accepting, agreeing to accept, that particularoffer in order to make this case go away. now, there's almost like a compromise. eachside is giving up something. each side is giving up a right to do various things. now,professional attorneys don't turn around and jump up for joy and say, yes, we won! no,because a settlement is not a particular win. each side walks away knowing that they couldhave done better, they might have done better, each side might have done better. the realityis, going to trial is a risk and nobody knows what the outcome is. the only time you'regoing to trial is when the defense refuses
