giving noticein this video, you will learn how to tell the other people or companies in a lawsuitthat you filed a document. this is called giving notice.anytime you file a paper in court, like an answer or a motion, you must give notice tothe other people or companies involved in the case. these people or companies are calledthe other "parties." giving notice to the other parties allowsthem to respond to your request or what you've filed. if the other side in your case filessomething with the court, they must provide you with notice, too. if you cannot show thatthe other parties were notified, the judge may not hear your request or let you use whatyou filed.

to notify the other parties, you must givethem: - a notice of motion or notice of filing,and - a copy of the court document, like youranswer or motion. both the notice and the document must be filedand stamped by the clerk at the court. you should fill out a "notice of motion"form when you file a motion. a motion is a request for the judge to take some action,like moving a court date. you should fill out a "notice of filing"form when you file documents other than a motion, like an answer to a complaint.after you file your notice and the other court document you must show the court that yougave notice to the other parties.

you do this by filling out a proof of serviceform. this form has a sworn statement stating: 1) how you gave the papers to the other parties,either by handing it to them, or mailing it to them. and,2) the date that you personally delivered or mailed the papers.you should file this form with the court after you sign it.for sample forms and more information on giving notice, see your local circuit clerk's officeor visiting illinois-legal-aid-dot-org.
